I do hereby declare that I understand the conditions set out herein, that I agree to abide by such conditions as well as all terms, conditions, rules and regulations which may be imposed by International College of Kinesis (Pty) Ltd pertaining to my participation in this training course(s) or any related activity whatsoever:

I hold harmless and indemnify International College of Kinesis (Pty) Ltd, as well as other students, and all officials employed by International College of Kinesis (Pty) Ltd, its servants, representatives, employees and agents, against any claims of whatever nature, including costs and expenses, in respect of my injury, loss and damage to property irrespective of whether such injury, loss or damage to property may have been caused by an actor omission whether negligent or reckless or otherwise, of any such person. I acknowledge that I am aware of and understand fully the risk and dangers associated with my participation and I hereby assume and consent thereto.

International College of Kinesis (Pty) Ltd shall not be liable for any loss or damage in any circumstances whatsoever arising from and in respect of my injury, loss or damage to property, however caused and howsoever arising. I acknowledge that I shall be solely responsible for any decision as to my own health and physical fitness to participate in this training course(s) and all its activities and whether to continue or discontinue to participate in this training course and all its activities at any time. . I warrant that I am in good health and that I do not suffer from any illness or disability that may make it unsafe to participate in this training course(s) and all its activities. I understand the risk involved in participating in this training course and all its activities and attest that I am in sound physical condition. I hereby agree to hold harmless International College of Kinesis (Pty) Ltd, the organisation, its owners, agents, directors, employees, accrediting organisations and associated bodies and all its sponsors from any and all liability arising out of this course(s) including, but not limited to, muscle strains, tears, pulls, broken bones, any and all illnesses or loss of or damage to personal property.

I hereby declare that I shall obey all the rules and regulations set out by International College of Kinesis (Pty) Ltd in any way concerning my participation. I also agree to all conditions of registration, including, but not limited to refund policy. I agree to pay a minimum, non-refundable deposit as required by International College of Kinesis (Pty) Ltd before the commencement of the course(s). I agree to a minimum cancellation fee of 20% on all course fees due, to be levied prior to the commencement of any course(s), and a 50% cancellation fee on all course fees due, to be levied after the commencement of any course(s). I understand that no refunds will be considered upon cancellation of the course beyond the set time limitations and if I do not return all course manuals and material supplied to me by International College of Kinesis (Pty) Ltd.

International College of Kinesis (Pty) Ltd reserves the right to edit, adapt or remove any part of the contents included in existing course material, lecture notes, class demonstrations and presentations and its contents at its sole discretion. International College of Kinesis (Pty) Ltd reserves all rights under copyright, trademark and other applicable law with regard to equipment, course materials, manuals, lecture notes, class demonstrations, presentations and its contents. The contents of this course material is the sole property of International College of Kinesis (Pty) Ltd. International College of Kinesis (Pty) Ltd prohibits any form of reproduction or copying of course materials and manuals. Course materials and manuals are made available to students subject to the condition that it shall not, by way of trade or otherwise, be lent, resold, hired out, or otherwise circulated.

I acknowledge that I have signed the above terms and conditions of enrolment of my own free will and volition and that I have not been involved to sign this indemnity as a result of duress and/or any representation of whatsoever nature by any official, servant, representative, agent or employee of International College of Kinesis (Pty) Ltd.

Services

Limitation of liability INTERNATIONAL COLLEGE OF KINESIS (PTY) LTD will not be liable, in anyway whatsoever, for damages, liability or losses resulting from the material, nor any other matter as governed by this Agreement, whether incurred by the Company and/or Learners, unless such damages, liability or losses are direct results of INTERNATIONAL COLLEGE OF KINESIS (PTY) LTD’s gross negligence.

Course material shall be supplied to the student in parts as tests are submitted to ICK for correction;

All equipment, course materials, manuals, lecture notes, class demonstrations, presentations and all its contents are made available by International College of Kinesis (Pty) Ltd without warranties or guarantees of any kind. International College of Kinesis (Pty) Ltd disclaims any liability for injury or damage resulting from the use of this information, equipment and other resources that may be mentioned or made accessible through all equipment, course materials, manuals, lecture notes, class demonstrations, presentations and its contents. By registering for this course(s) I agree to indemnify, defend and hold harmless International College of Kinesis (Pty) Ltd, eee avalaible to meity for anybe made until I ied quired by ationres / modules).........the organisation and its owners, agents, directors, employees, accrediting organisations and associated bodies and all its sponsors against any liability for any equipment, course materials, manuals, lecture notes, class demonstrations, presentations and its contents made available to me.

The Post Office acts as agent for the student for the acceptance and conveyance of all study material or correspondence addressed to the student or to INTERNATIONAL COLLEGE OF KINESIS (PTY) LTD;

The replacement of study materials shall be for the account of the student;

Study material supplied to students may not be passed on or access given to any one other than the registered student;

Fees charged by INTERNATIONAL COLLEGE OF KINESIS (PTY) LTD exclude Registration for Institutes and other external bodies.

Fees charged by INTERNATIONAL COLLEGE OF KINESIS (PTY) LTD exclude Exam fees.

Certificates/Diplomas will only be issued once the student’s account has been settled in full and all applicable exams and tests have been completed.

INTERNATIONAL COLLEGE OF KINESIS (PTY) LTD does not accept responsibility for a student’s eligibility or entry for public examinations;

Examination Courses (other than Computer Studies):

INTERNATIONAL COLLEGE OF KINESIS (PTY) LTD guarantees to update material for two consecutive exam sittings from the study material issue date, provided that the student is within the contract period;

If necessary, an extension can be granted, provided that INTERNATIONAL COLLEGE OF KINESIS (PTY) LTD is notified promptly when the student is prevented from studying through illness or reasons beyond his or her control.
The student will required to sign an Agreement between Him-/Herself when he or she receives their student packs.
